The Appellate Division upholds HC verdict on govt formation in 2024

The Appellate Division of the Supreme Court today upheld a High Court verdict that justified the formation and oath of current interim government led by Prof Muhammad Yunus under this court's opinion.

A seven-member bench of the Appellate Division headed by Chief Justice Syed Refaat Ahmed unanimously dismissed a leave to appeal petition filed by lawyer Advocate Muhammad Mohsen Rashid challenging the HC judgement.

The apex court also issued an observation along with the order but did not disclose its contents during the announcement around 9:45am today.

The observation will be known when the full text of the order will be released.

Rashid had challenged the HC order that upheld the formation and oath of the interim government under the SC's opinion.

On January 13, the HC summarily rejected his writ petition questioning the process for the formation and oath of the interim government.

In its full text order, the HC observed that the interim government led by Yunus was supported by legal documents and formed by the will of the people.

Rashid filed the leave to appeal petition with the Appellate Division on February 25, challenging the HC order.

During the hearing before the apex court, Rashid represented himself, Attorney General Md Asaduzzaman and Additional Attorney General Aneek R Haque represented the state, while senior lawyers Md Ruhul Quddus Kazal, Sharif Bhuiyan, Mohammad Shishir Manir and Shahriar Kabir placed arguments as interveners.
