Hefazat-e-Islam Bangladesh today demanded amendments to the recently passed Transfer of Property (Amendment) Bill, 2026, claiming that its provisions concerning “hiba”, or gifts under Muslim law, conflict with the Quran and Sunnah.

The organisation made the demand at an emergency meeting in Dhaka chaired by its Ameer Shah Muhibullah Babunagari, according to a statement issued by Hefazat-e-Islam Office Secretary Maulana Afsar Mahmud.

The meeting expressed concern that the changes concerning "hiba" could create legal complications for Muslims and criticised the government for passing the bill without consulting Islamic Shariah experts.

“The law is contradictory to the Quran and Sunnah. No law contrary to Islamic Shariah can be acceptable in a Muslim-majority country. The bill must be amended,” the statement said.

Criticising the recent remarks made by the law minister and the parliament chief whip, the statement said, “Our message to the policymakers concerned is: do not ignore the Islamic scholars; listen to their views with due importance.

“Instead of questioning whether those who raise objections on any issue have studied law, it is the responsibility of a responsible state to examine the Shariah and legal basis of their objections,” it added.

Hefazat said the state had a responsibility to respect Muslim personal law and Shariah-compliant system of property distribution.

It said it would continue peaceful and lawful protests against the disputed provisions.

The organisation also demanded an immediate review of the provisions to protect the practice of "hiba" and the rights of Muslim heirs.

The meeting decided that a delegation comprising Hefazat leaders and Islamic jurisprudence experts would seek a meeting with Prime Minister Tarique Rahman to press for amendments to the bill.
