Nahid Islam, convener of the National Citizen Party (NCP), has filed an application with the Appellate Division challenging a High Court order that dismissed a writ petition seeking the cancellation of the candidacy of BNP-nominated candidate MA Quayum in the Dhaka-11 constituency over allegations of dual citizenship and concealment of information.
Nahid’s lawyer, Zahirul Islam Musa, confirmed the matter o Saturday, saying the application may be heard on Sunday before the Chamber Judge of the Appellate Division.
Earlier, on February 2, Nahid filed a writ petition with the High Court challenging the legality of Quayum’s candidacy and seeking a stay on his participation in the election in the Dhaka-11 constituency. On February 3, the High Court summarily dismissed the petition.
Following the order, Quayum’s lawyers said there was no longer any obstacle to his participation in the election in Dhaka-11. The order was delivered by a High Court bench comprising Justice Fahmida Kader and Justice Md Asif Hasan.
Previously, the Election Commission declared valid the nomination papers of both Nahid Islam—the candidate of the 12-party alliance and NCP convener—and MA Quayum, the BNP-nominated candidate and the party’s secretary for microfinance affairs, for the Dhaka-11 constituency.
